Trump upset over Chief Justice Roberts’ defense of “Obama judges”

On November 21st, Chief Justice Roberts criticized Trump for describing a judge who was against Trump’s asylum policy as an “Obama judge”. Jon S. Tiger, a judge of the United States District Court in San Francisco, opposed Trump’s policy, which seeks to get rid of the protections provided to immigrants who enter the country illegally, regardless of whether or not they are seeking asylum, saying that Trump could not “rewrite the immigration laws to impose a condition that Congress has expressly forbidden”.

Trump was upset and annoyed about this, calling Tiger an "Obama judge". Chief Justice Roberts' defended Tiger, saying that Tiger was just doing his job, and that there are no "Obama judges or Trump judges, Bush judges or Clinton judges" in the court system, only an "extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them." Trump was quick to respond using his customary means of communication, Twitter, saying that there were in fact "Obama judges," and that they had different views than that of the people keeping the country safe. Trump also expressed his displeasure with the 9th Circuit, complaining that 79% of his decisions have been overturned in the 9th Circuit.

In my opinion this whole thing just goes to show how divided this country really is, on one side you have Republicans who want to completely get rid of any immigration if the people immigrating aren't white, and on the other side you have the Democrats who are for immigration of all races and ethnicity. The justice system at this point is so divided and partisan that a decision made in one state for a crime can be an entirely different decision in another state for the same crime, its disgusting.

Questions:
Does Trump have the jurisdiction to enforce his policy, or does he have to get Congress's approval first?

  1. I think that Trump needs to respect the decision of the judge to strike down his immigration policy. Calling someone an "Obama judge" is not going to help his case. The judges are chosen specifically to be non-partisan and unbiased to the best of their ability, and just because one happens to disagree with Trump doesn't mean he is an "Obama judge"

  2. I want to comment on how Trump is still obsessed with Obama, and seems to blame almost everything, whether it be policy or officials placed into office, on his predecessor. I don't think any other president in US history disdained the previous president as much as Trump, and almost halfway through his presidency it seems like he's still running on his campaign rhetoric of "fixing" everything Obama did during his presidency, By now, many of Trump's own policies have been implemented, and he is still blaming policies from the previous administration.

  3. I don't think Trump has the power to enforce his policy. I think as the president, he has limits on what he can and can't do and I think he's definitely trying to overstep them and do what he wants. I think Congress should approve or make changes like this, not trump and I also think trump is using the term "obama" judge to spike more division between people over how they may feel towards a certain president, like people blindly supporting trump

  4. I agree with you that this divided system can be "disgusting" on making decisions but what we have is what we have. I think the overarching issue here is whether we want to preserve our institution of democracy, as in one there will always be "sides", or to create unification on decision making under one guiding principle. A resolve to this issue: there needs to be a conference of some sort where we go over what the strict limitations of each position in our government, educate leaders, (mostly Trump) and move forward with a clear sense of what each role does.

  6. I believe that Trump needs to the permission of Congress to enforce his policies. I believe he should also respect what the judges have to say.

  8. The sole purpose of the checks and balance system is so that one branch does not get too much power. If Trump is able to just go around congress then it would give him too much power. He should not be able to complain when congress disagrees with his ideas. This kind of attack on people who disagree with him show just how immature he is.
